Terms of Service

These terms govern your use of the DriveGuardians fleet safety program, hardware, and associated services.

1. The Program

DriveGuardians provides a fleet safety intelligence program including AI dashcam hardware, driver behavior scoring, incident video management, coaching workflows, and monthly safety reports. The program is available in two plans:

  • Fleet Safety: $58/vehicle/month — core AI dashcam monitoring, scoring, incident alerts, monthly reports
  • Safety Intelligence: $88/vehicle/month — adds predictive risk scoring, custom KPI reporting, extended video retention, and priority support

Pricing is per active vehicle per month. A vehicle is considered active if the dashcam is installed and connected in that vehicle during any part of the billing period.

2. Pilot Program

New fleet accounts are eligible for a 90-day pilot program covering 3–5 vehicles at no hardware cost. After the pilot period, standard per-vehicle monthly pricing applies unless the account is cancelled in writing before the pilot end date. Hardware deployed during the pilot is subject to the hardware terms in Section 4.

3. Subscription & Cancellation

Billing

Subscriptions are billed monthly per active vehicle. The first billing cycle begins at the end of the pilot period or at activation if no pilot is used. Billing continues until written cancellation is received.

Cancellation

Cancel with 30 days written notice to SafeDriving@DriveGuardians.com. Cancellation takes effect at the end of the notice period. Monthly fees for the notice period are non-refundable.

Enterprise accounts

Fleet accounts with 20+ vehicles may request Net-30 payment terms and annual contract pricing. Contact us for enterprise terms.

4. Hardware

Hardware purchase

The AI dashcam is a separate hardware purchase — not included in the monthly program fee. Hardware pricing is shown at checkout. Shipping is calculated at checkout via USPS Priority Mail.

Pilot hardware

Hardware deployed during a 90-day pilot is provided at no cost for the pilot period. If the account does not convert to a paid subscription, hardware must be returned in resalable condition within 30 days of pilot end. Unreturned pilot hardware will be invoiced at the standard retail price.

Hardware return policy

You may return purchased dashcams and receive 50% of the original hardware purchase price (excluding shipping) provided:

  • Return is initiated within 60 days of subscription cancellation
  • A Return Authorization number has been issued — request via SafeDriving@DriveGuardians.com
  • Hardware is received in resalable condition: functional, physically intact, clean, complete (unit, cable, and mount), and not tampered with

We inspect returned hardware within 5 business days. If the unit passes, the 50% refund is issued within 7 business days to the original payment method. Hardware that does not meet resalable condition standards may receive a partial or no refund at our discretion.

5. Installation

Self-installation

Dashcams are designed for self-installation via the vehicle's OBD-II port. Instructions are included. You are responsible for ensuring proper installation.

Professional installer network

Upon request, DriveGuardians can connect you with vetted local installers. This is a referral only. DriveGuardians is not a party to any agreement between you and an installer. The installer sets their own fees and is independently responsible for their work. DriveGuardians is not liable for installer fees, availability, scheduling, or workmanship. Installation is at your own cost.

6. Biometric Data — Fleet Operator Obligations

⚠️ As the fleet operator, you are responsible for obtaining all required driver consents before activating facial recognition features. This is your legal obligation — not DriveGuardians'.

The DriveGuardians AI dashcam uses facial recognition to identify drivers and link detected behaviors to individual driver profiles. This constitutes biometric data collection under applicable state laws.

Your obligations as fleet operator

  • Obtain written, informed consent from each driver before activating facial recognition in their vehicle, including BIPA written consent for Illinois-based drivers
  • Maintain consent records for all drivers
  • Monitor and comply with applicable biometric privacy law in all jurisdictions where your vehicles operate, including future changes to applicable law
  • Notify DriveGuardians if facial recognition must be disabled for any vehicle or driver due to legal requirements in their jurisdiction

User responsibility for evolving law

Biometric privacy laws are rapidly evolving across the United States. It is your responsibility as the fleet operator — not DriveGuardians' — to monitor and comply with applicable biometric law in all jurisdictions where your fleet operates, now and in the future. DriveGuardians' obligation is limited to the disclosures current as of your sign-up date. Rights that cannot be contractually waived, including the Illinois BIPA private right of action, are preserved regardless of this agreement.

7. Acceptable Use

You agree not to:

  • Install dashcams in vehicles without authorization from the vehicle owner
  • Use the program to monitor drivers without their knowledge where legally required to disclose
  • Share video footage or safety scores publicly in a way that identifies individuals without consent
  • Tamper with dashcam hardware or attempt to alter safety score data
  • Attempt to reverse-engineer the platform or AI scoring systems

8. Disclaimer & Liability

⚠️ DriveGuardians is a fleet safety intelligence tool, not a guarantee of accident prevention. The program does not prevent accidents. You remain responsible for driver safety and fleet operations at all times.

DriveGuardians provides the platform "as is." We do not warrant that the service will be uninterrupted or error-free, or that AI detection will capture every driving event. AI detection has limitations and may miss events or generate false alerts.

To the maximum extent permitted by law, DriveGuardians' liability for any claim arising from use of the program is limited to fees paid in the three months preceding the claim. DriveGuardians is not liable for accidents, injuries, property damage, insurance outcomes, or regulatory violations regardless of whether the program was in use.
